AGM Resolution text

The Government has amended the Building Maintenance and Strata Management Act (“BMSMA”) to lower the resolution threshold for EV Charger Installation proposals to an ordinary resolution requiring simple majority of votes at meeting, with the aim to make it easier to install EV chargers in strata-titled developments.

These are the type of proposals that the lowered resolution threshold applies to:

1. Enact by-laws on the use of parking lots for EV charging (e.g. designating charging lots to be used only by EVs)
2. Install / Uninstall EV chargers, as long as:
   • The lease contract between MCST and EV charging operator does not exceed 10 years; and
   • The proposal does not draw down on MCST funds

Ordinary Resolution: Proposed Exclusive Use of Common Areas for Installation and Operation of Electric Vehicle Charging Stations

To consider and if thought fit, resolve by way of an Ordinary Resolution to empower the Council to (1) Confer use of common areas as approved by the Council to the selected Vendors) for the installation and operation of Electric Vehicle Supply Equipments) (EVSE) in the carpark at no cost for a period not exceeding ten (10) years; and (2) Authorise the Council to determine fees, location of the chargers, manner of installation, terms, and conditions as it deems fit.

(Note: For an ordinary resolution to be passed, at least 50% or more of the share values present or in proxy must vote for the resolution.)

To consider and resolve by Ordinary Resolution, to empower the incoming Management Council to appoint a Vendor/Operator to install Electric Vehicle (EV) Chargers for MCST XXX on common property for a period of less than 10 years.

The installation, operation, and maintenance of the EV charging stations shall be funded entirely by the Vendor/Operator, with no utilization of funds from the MCST's Management Fund or Sinking Fund. Vendor/Operator shall be allowed to increase the number of car park lots as and when deemed fit, in consultation with Management Council.

This motion shall not be discussed should the above motion is defeated.

To consider and if approved, resolve by way of a Special Resolution, to adopt the by-laws governing the use of Electric Vehicle Charging Lots.
(Note: For a special resolution to be passed, at least 75% or more of the share values present or in proxy must vote for the resolution.)

• The use of EV Charging Lots are restricted to residents only
• Any non-EV found parked within the EV Lot will be wheel-clamped
• Residents shall move their EV out of the EV lot once their vehicle is fully charged or the selected charging session is completed. Once notified by the EV charging system, residents have a grace period of 30 minutes from 7 am to 11pm to vacate the EV lot, after which they will be subjected to an occupancy fee.
• Residents shall return the EV charging cable to the charging station after use.
• Residents shall inform the EV charging company or Management Office if they observe the EV charging stations are not functioning
• Management reserves the right to close the EV charging stations for maintenance, repair and any other reasons as it may deem fit.
• Management shall not be held responsible for any injuries, damages or loss (including consequential loss) incurred as a result of using the EV charging stations.
• Residents are reminded to exercise due care and caution when using the EV charging stations.
• Management reserves the right to adjust the charging fees from time to time without prior notification if deemed necessary in accordance to the market trend
• EV owner to be fully responsible for any liabilities and accidents arising directly or indirectly from the charger
• Residents to be fully responsible for the purchase of efficient individual insurances including but not limited to, public liability, all risk, etc coverage.
• MCST to take full responsibility for getting the required prior approval from the authorities (EMA, LTA, NEVC, etc.)
• Vehicles parked in the carpark will be at the owner's risk. The Management disclaims all liabilities of theft, vandalism, misdemeanour, or any damage caused to the vehicle and/or their contents.
• The Management Corporation reserves the right to cease the EV owner usage of the charging point and/or terminate the usage if found in abuse of facility herein with immediate effect in writing without further reference
• The Management Corporation reserves the right to amend any of the above terms and conditions or withdraw the application herein at any time.
